للقاعدة الجنائية التجريمية وظيفة جوهرية وهي تحديد الأفعال المجرمة على وجه واضح؛ إذ أن أي لبس أو غموض في هذه القواعد قد يؤدي، عند تفسيرها، إلى خلق جرائم أو تطبيق عقوبات على غير ما يهدف إليه المشرع، وهو أمر من شأنه أن يحول دون تحقق العقوبة غرضاً هاماً وهو الردع العام، ولذلك يستوجب وضع قواعد قانونية واضحة ومحكمة، لتمكين الأفراد من معرفة مكونات الجرائم وأنواع العقوبات واجبة التطبيق من خلال القواعد التي يضعها المشرع.

Abstract

The incriminating criminal rule has an essential function, which is to clearly define criminal acts. Any ambiguity or ambiguity in these rules, when interpreted, may lead to the creation of crimes or the application of punishments other than those intended by the legislator, which would prevent the punishment from achieving an important purpose, which is general deterrence, and therefore requires the establishment of clear and strict legal rules. To enable individuals to know the components of crimes and the types of penalties applicable through the rules established by the legislator.
