 نتيجة للتوسع الحاصل في مختلف المجالات و ازدياد الاحتياجات بات من الطبيعي ان يضطر الأشخاص الى الارتباط بعلاقات عقدية بدافع الحاجة او بسبب امر خارجي، اذ ان فكرة الاضطرار تقوم على الاحتياج او الالجاء، و قد يبدو من البديهي و لأول وهلة ان الاضطرار الى التعاقـد اطار العلاقات المختلفة ومنها الجانب الطبي، هو امر طبيعي اذ لا يقدم الشخص على العقد الا اذا كان محتاجاً و الاحتياج هو امر فطري لمواجهة متطلبات الحياة، لكن امعان النظر في موضوعنا هذا يدفعنا لتسليط الضوء على تلك العلاقات العقدية التي تبرم بدافع الاضطرار لا سيما ان التطور الذي اشرنا اليه ِ و على مختلف الجوانب يدفع الافراد الى ابرام العقود تحت تأثير الاضطرار، فالاضطرار في مثل تلك العقود يكون بسبب التفاوت المعرفي بين طرفي العلاقة العقدية، ومن اهم مصاديق ذلك عقد العلاج الطبي.

ان ما يتسم بهِ عقد العلاج الطبي من تفاوت معرفي على النحو الذي سنراه، يجعلهُ بلا شك مصداقاً وتطبيقاً عملياً يتجسد فيه الاضطرار الى.
